The only format that always has a form of DRM applied to it is KFX, and since that can't be converted at all yet anyway, your statement doesn't apply at all.

that is utter nonsense. I have well over 100 books bought from amazon in mobi / azw formats before KFX was even invented, and they all have DRM.

why would there be a web site with toolo for removing Amazon's mobi / AZW DRM if that did not exist ?

Kindle ebooks certainly can have DRM. However, not all of them do. Any ebooks from Tor, for example, are free of DRM.

Ok i dont have any tor books from amazon. Do amazon sell tor books?

Nomenclature, i say kindle book meaning from amazon. I also have mobi books, drm free , from humble bundle but i dont call those kindle books. If you use kindle book to mean something that works on a kindle then we are not on the same page, as it were.
Lets agree then that most books in the older mobi, azw formats ARE encrypted and work only on the downloading device, though of course if you own more than one device you only need buy the book once and then do multiple downloads.

My point was dont mislead someone new to ebooks by suggesting that the older formats are drm free in all cases.

Most titles from Big publishers, yes. Most titles overall I'm not so sure as most self-pub and quite a few smaller pubs, plus some big pub titles have no DRM when coming from Amazon. The problem is that for most people they have no way to tell if a Kindle book has DRM or not so it's often best for them to assume that whatever they're buying might have DRM (and running a non-DRM'd book through Alf's tools won't hurt it).

I have read, but do not have an evidentery link to hand, that amazon apply drm to books even when the author or publisher has asked for said books to be sold drm free. Cory Doctorow is a possible example.

Some debate here, plus the claim that it is illegal to remove amazon drm.

It's certainly possible Amazon has done that mistakenly at some point, but without a specific case it's hard to say. The author/publisher chooses whether to add DRM as part of the process of uploading the book to Amazon. The only times I've heard of DRM being applied when unwanted were when the author mistakenly checked the box to DRM the book. I have 12,144 books in my Amazon library. The majority have no DRM.

I know Doctorow doesn't use DRM on his titles and had some trouble getting Audible, which is owned by Amazon, to sell them that way at one time, but later they agreed to do so (except Apple, who Audible provided Audiobooks to exclusively at the time required DRM). I think it's still not easy to get Audible to sell titles DRM free, but I'm not sure as I haven't looked into it.

I read a claim in the page at that link that neither the author nor the publisher could authorise someone to remove DRM. That's not the same as a claim saying it's illegal.

Please use capitals. It makes it easier to read what you're writing. I was referring to books published by Tor, not books from a torrent.

And yes, Tor does sell its books, DRM-free, through Amazon.

Easy way to tell:
Scroll down to the book's information.
Simultaneous Device Usage: Unlimited
That is DRM free.
If there is a 6 instead of Unlimited, it has DRM.

Most of my Amazon books are DRM free.

Yes, I know but would wager most folks don't. Of course I'd wager most folks don't care at all if a book has DRM or not.

I would wager most folks that convert their books would know this.
And no, I won't take your bet because you are absolutely correct.

Though why would books need an oil field company?

I think for books that are downloaded in the new format (kfx?), DRM is always applied; I think I read this in a discussion in the Kindle forum.

It depends if the eBook has DRM or not. If you download a KF8 Tor eBook, it won't have DRM and can easily be shifted to ePub.
