Apple doesn't sell music based on Agency, I see no reason why they couldn't continue to sell books without Agency pricing.

I don't know who sets the price. I do know I can usually find my music downloads cheaper (and more of them) at Amazon than at the iTunes store, and I've got my Amazon downloader to download directly into iTunes.

I wouldn't hold your breath if I were you. New contracts need to be drawn up - that's going to take more than a day or two to happen.

The settlement has to be approved by the courts and new contracts have to be written up.

AFAIK, the courts have't ruled on the settlement. We are still within the 60 day public comment period, so I don't know that the settlement has even been submitted to the court yet. Its possible that the DOJ might tweak the terms based on the public comments and that there even may be a further round of public comments and negotiations among the parties before the court gets it-and the court may reject it then.

Are they really playing King Canute if they think agency pricing of ebooks will uphold dt sales?
I don't know about other e-reader owners, but since I got my Kindle (August 2010) I have bought lots of ebooks and only two dt books. I am still reading some dt books, but they are ones I bought pre-kindle. |

The 60-day comment period started on April 11, 2012.
It's now June 10, 2012. 60 Days later. The comment period is about to be over. Next up is the approval of the settlement by the court. Once that is done, If the settlement is approved — following a 60-day comment period — those three publishers must terminate existing agreements with Apple’s iBookstore within seven days. |

First they have to be found guilty. The settlementonly effects the three publishers that settled. Lower prices may come in a few months. The public commentary on the settlement period has ended. Noe the Judge has to read all the comments and determine if the settlement is fair.
