Personally, I think you have an interesting concept here. As for the other lending sites out there maybe i am daft, but I have been unable to really find any... At least with current books. I would love to find a group to lend my books to as none of my friends or family have readers. I have purchased 12 books since Christmas and they are all lendable ( but noone to share with ). Your question about moderating I would be interested to find out more about it. I am an Internet Marketing Specialist and could possibly be of some assistance on that end...I market real estate professionally though so a bit of a different ball game there.

I think it's debatable whether it's against the law (certainly it would depend on what country the people were in), but you can easily say "we're not supporting that; 'lending' a file while keeping it active on your own device is not what this service is for."

I don't think Kindle & Nook lending software features will work with books that have had their DRM stripped. However, I don't know what you'll be doing to track the lending, so you might not have a way of knowing if the exchange was an actual through-the-software ebook lending, or an emailed copy of the ebook.

I expect that some people would be careless about that, and when they say "X emailed me a book" instead of "emailed me the link to download from Amazon," a followup question could let you know what really happened, and you could ban people found to be using the site for private ebook exchanges. You'll probably miss a few, and it's really probably not worth trying to track those down.

It may not be, FOR PERSONAL USE. But giving copies of your book to somebody else is not personal use, and is unquestionably a breach of copyright.

And before someone gets the wrong idea... I'm not against these lending websites -- that simply connect borrowers with lenders -- in theory. But, I just see them as becoming a bit of a facilitator for piracy in practice. Since the website won't be handling the actual ebook "exchange" itself, I fail to see how they will ensure that each ebook that is loaned is a legal lend-able copy.

Sure, the website may not be legally responsible for what their members choose to actually "exchange", but remember... legality is just an interpretation away from illegality.

I know you can't stop piracy in its tracks, but I would prefer that those who wished to procure elicit free copies of ebooks had jump through a few technological hoops (that may discourage a few) rather than simply signing up on a waiting list that will shoot you an email when "your ebook's done."

If you're serious about trying to prevent illegal activity -- consider moderating (or banning) members who attempt to loan the same title more than once.

And for god's sake... talk to a lawyer to CYA.

This. The phenomenon, imo, also shows that average readers (i.e. not 'pirates') do respect DRM restrictions, but will quickly adjust according to their limits when lowered. Remove DRM entirely and that lending site becomes a giving site. Which highlights what DRM is really meant to prevent: not organized pirating, but casual copying/sharing.
