In short: it was neither a good day for my uncle or his lawyer. Warning: it's a long story.

It all started with that my uncle, and his lawyer, didn't want my uncle (aunt's husband) and sister present in the court room. His lawyer tried to tell this to the judge, but wasn't very articulate. To which the judge said: "I'm going to put words in you're mouth now, but you want to ban those people. Do you have a good reason?". The lawyer didn't, and since it wasn't a case behind closed doors the judge allowed my sister and uncle to stay.

All the lawyers were allowed to have their say. Our lawyer made our final offer: pay more for the house on the condition my uncle would have to waive his right to his part of the inheritance. If he did this we wouldn't go to court over the costs he had my grandmother pay on his behalf (insurance, sex dating sites, lawyer's fees, etc). He would be lucky that way: his part of the inheritance is less than half of the money he owed. My uncle's offer was that he wanted his part of the inheritance (€20000) and he didn't care anymore what would happen to the house.

The judge told him he was already 0-1 behind after the previous verdict and that the offer my father had made was a fair one. He also warned that there was a big possibility if the negotiations didn't work out my uncle would lose.

My uncle's lawyer was also caught off guard by the claim of €43000 that my uncle had to repay. I don't know why: our lawyer had also brought this in the previous case in August last year.

Then everyone was send out, and the lawyers had to negotiate. My uncle's lawyer was overwhelmed by that our lawyer and my aunt's had teamed up (what did he expect?) and even walked out for a while because he didn't think it was fair that our lawyers had decided on a strategy together. Eventually no agreement was made (not surprisingly).

In court the judge told my uncle he had six weeks to send in his Letter of Grievances (why he wants to appeal) and advised to keep negotiating during that time and warned my uncle again that it was a real possibility he would lose.

On the one had we don't want my uncle to get any inheritance. On the other hand, after 5 years and a lot of money it would be nice to finally close the whole thing. Also, continuing would cost more and if my uncle loses again he can go for another appeal, which will cost us €10000 just to start it.

Our lawyer has already said that we won't agree with €20000 and is going to try to negotiate the figure down. To the judge she also said that my uncle would be very lucky if he got €5000, so I assume that's her target figure.

My father and sister and now putting together a clear and detailed overview with appendixes of those €43000 my uncle owes for our lawyer. After that it's another waiting game.

My day was both stressful, at least the first six hours until my sister called, and mindnumbingly boring. It was a very quiet day, as expected, but luckily I had some good customers so it wasn't a complete waste.

This sounds VERY positive to me, Rumple. That judge--you should make sure you keep him/her. Him, right? I mean it, I've spent a lotta, lotta time in courts, professionally, and that sounds quite good. I'm optimistic for you.

Yes, we did have the feeling the judge was on our side. He also got annoyed with my uncle's lawyer several times because he had a hard time trying to say what he meant to say.

And since he warned my uncle and his lawyer four times that if the negotiations fail and the proceedings go ahead that there's a real chance my uncle will lose the case and he will be left with nothing.

During the hearing yesterday my father described how first my uncles face got more and more red, then his neck, which also proceeded to swell and a vein started throbbing. My father expected that my uncle would explode in rage in the court room, but (unfortunately) he didn't.

We'll have this judge for this appeal AFAIK.

It does seem like they didn't prepare at all for yesterday. And it seems that the only reason why my uncle appealed is not to win, he seems to have realized he won't, but to get as much money from it as he can.

If it was up to my father and my good uncle (aunt's husband) they would continue and wouldn't agree that my uncle would get any money. But my aunt is very stressed and won't be able to handle much more of this. Also it would cost more to continue than when we pay our uncle off (because that's how it feels).

Fun story. The negotiation in these types of cases is done by the lawyers. Our lawyers had told my father and aunt this, so when the negotiations started they moved off to a different table. My uncle joined his lawyer and said: "Let's negotiate.". Our lawyer told him that the negotiations would be done by the lawyers. When my uncle kept hovering she literally told him: "Why don't you move over there, then we can get the negotiations started.". My uncle didn't like that! I would give a lot of money to be able to see his face at that moment.

We'll see how it goes during the next six weeks. One of our non-negotiable demands is that my uncle has to sign that he will never, ever try to get the whole thing started again.

I'm have GAS, Gadget Anticipation Syndrome.

Today I've ordered my new tablet. A Lenovo Tab 4 10 Plus. My current tablet, which is 8", is having some problems with charging; the connection is starting to get loose and it's charging slower than it used to. Lately, I've also been watching more Netflix on it than before, when I only did that when I was on vacation or when I was house sitting. So all this was a good excuse to get a new tablet. I ordered a Lenovo because although they are slow with updates, they don't have a lot of crap and bloat ware and they've kept the original Android UI, which I like.

So tonight I'm making sure I've things backed up and synced on my old tablet so the installation and set up of the new one will go as smoothly as possible.

Hoping tonight my bedroom will finally cool down a bit. It's been a warm couple of week, and it usually takes a while for my bedroom to get warm but it also takes ages to cool down. I haven't slept well in a while. But the predictions are that next week temperatures will go down, also at night.

Currently it's still 23C (73.4F) in my bedroom. Ideal temperature for sleeping for me is 18C to 20C (64.4F to 68F).

For me sleeping temp is 70-72F any colder causes me to sweat. We try to keep the front of the apartment 72-73F with the back room 75. It was with heat index 101F yesterday. I was visiting my mother at the nursing home and we don't have good a/c in our vehicle. She kept wanting to go outside for a picnic, crazy woman! I came home and fainted from heat exhaustion.

So here I am up early because I fell to sleep early. Hungry but can't eat without risking waking hubby up who has to work in an hour.

I've just watched the first episode of Ash vs. Evil Dead on Netflix. Wow, not sure what to think. I know I've seen the first film, possibly the second, but that was in the early 90s. I think I will need to go back and all three films. But still, that series is just WTF.

I haven't been doing a lot of creative things lately. It's been a busy couple of months and when I have a bit of time I don't feel like setting up for a creative session.

To motivate myself I've set myself a challenge this week that I have to spend 30 minutes a day doing something creative. That can be working on a card, colouring, watercolouring, doodling, working on a mixed media piece or working on a bigger project.

Today I'm going to visit the craft store this afternoon to pick up my mixed media kit, maybe if I see something fun I'll treat myself. This morning I'm going to do some colouring, we have to run more errands today and I don't know if I feel like crafting after that.

If I succeed I've promised myself that I can order a couple of things from Stampin' Up
