I agree with the principle, but who in their right might was thinking of this stuff 20 years ago? Most of the worst conversions were from books published before e-books, HTML and common internet access.

Doesn't seem fair to expect the publishers to be prescient. It is fair to expect publishers to notice that these older books can't just be scanned, skimmed, and sent out for sale.
