Someone on MR who had a problem with Calibre not working said he bought it from Microsoft and it worked once he installed Calibre from the official website. So if that is the case, then they are selling broken software that they broke.

Which is not the same as selling something illegally. We have no idea if that was a one-off issue, a breakage while they updated the calibre version, or breakage because they hadn't updated the calibre version. All those things happen with the official calibre releases.
