Yes they should have, but by them not having the decency to do the
right thing does not give a pass to others to also do the wrong thing.

It is a shame that this is even a question to be debated.

I see lost and stolen as two different things, sure if I found a kindle on the subway I would turn it over to the lost and found. If I lost my kindle somewhere and someone else found it I wouldn't think it was wrong of them to keep it, I am the one who lost it to bad for me. Ever see those people at the beach with metal detectors looking for rings, watches etc ? are they considered thieves ?

In my opinion amazon blacklisting lost kindles is wrong, if someone reports a lost kindle as stolen it is wrong.

The legal situation in the UK is this:

If you find goods that appear to be lost, then you can keep the goods as long as:-
  • you did not find the goods dishonestly or while trespassing
  • you take care of the goods
  • you did not find the goods on your employers’ property
  • the goods are lost, and not uncollected or abandoned, stolen or treasure
  • you have taken reasonable steps to find the owner of the goods, for example, left them to be claimed at a police station for a reasonable length of time
  • the goods were found not attached to anything on premises or land where the occupier does not exercise much control, for example, an air terminal lounge, public part of a shop, or recreation ground.

It's that requirement to "take reasonable steps to find the owner of the goods" bit that the issue. That would normally mean handing it in at a police station. If the owner hasn't claimed it within 6 weeks, it's yours to keep and the owner has no subsequent legal claim on it.

I have a simple view on this:

It is Lost right up to when it is Found.

It is Stolen as soon as the person finding it decides to keep
it and not take the steps to return it to it's rightful owner.

For me I could not in good conscious ever keep something like that
(since it can easily enough be traced back to it's rightful owner).

Its still useable you just dont have all the features a registered kindle has. maybe you could take it up with your bank since you wrote a check, maybe they would reverse the transaction. I think that unlikely though...

Really, you can't just deregister the Kindle from your account before you sell it so the new owner can then register it to their own account?
