On some topics, you see the same material quoted verbatim on many different internet sites. (Actually on a lot of topics. Try any medical syndrome.) I ran into this with some statistics about the Vietnam War. The same identical stats in the same bulleted format are on many different sites, word for word.
Aside from the question of just how valid these statistics really are, is there a point where constant unchallenged re-posting constitutes de facto permission? I used some of the numbers but rewrote it to add my own twist and to avoid straight copying. I also included a citation. I read up on fair use and this seemed reasonable given the vagueness of the standard. |

Perhaps. I believe US trademarks work that way. If you fail to defend them they lose legal authority.
