Yes, the recoveryfs has proprietary code on it. It includes a copy of the firmware to unpack to the rootfs during a factory reset (under recoveryfs/upgrade). I would assume anything in any "Kobo" directory is proprietary. Not all the files will be, but a good portion are. Plus there are fonts, images, dictionary files and other things that Kobo might have licensed.

If your plan is to publish a tool to generate an image from files that are obtainable from Kobo or the device, you are probably OK. But, if your plan is to host an image file publicly, you will need to be careful. And as I said, I can't see the point. Apart from doing it as a learning experience.

The animated squares are in the update zip files, the mkfs binary can be recreated, and a so can most of the others. The problem is the first 5 mb of the zip, and the Kobo directory.

OK, I have mostly given up by now, and it was a good learning experience, and when I have a chance, I will put some of the things I figured out on my page. Thanks for your help so far. I have learned a lot about how the Kobos have worked.

The first 5MB or so should contain the boot sector and maybe the start of the kernel. Both of these are written from files in the upgrade package. You can see this in /etc/init.d/upgrade-generic.sh.

Thks David for image, i was abble to restart my Kobo Glo HD, first freeze after the software update, restarted procedure, freeze again after Kobo ID registration...
Tried many restarts but it continues to freeze randomly.. Suspecting hardware issue now.
Investigating deeper

If you haven't, do a factory reset. That can clean up a lot of issues.
