Returning to the original topic of this thread, I see that the injunction has now been lifted (except in Germany) pending a further court hearing on 25th Aug:

A Düsseldorf court has temporarily reversed a portion of a preliminary injunction against Samsung's Galaxy Tab 10.1, allowing the company to sell the tablet outside of Germany.

Patent blogger Florian Mueller confirmed the news with the Düsseldorf court and said the "simple version" of the story is that "nothing changes for German customers, but Samsung's Korean parent company is free to sell again—for the time being—in EU countries outside of Germany."

That could change again at an August 25 hearing, but for now, Samsung is no longer banned from selling the Galaxy Tab 10.1 in Europe, except in Germany.

The article goes on to note that:

today's reversal isn't a judgment on the merits of Apple's case. Instead, it questions whether a German court has the right to enjoin a Korean company from selling products outside of Germany.

As I showed in my earlier posts, in terms of trade dress - which is the basis for this injunction - we have seen things very, very like it.

Samsung in particular were using the flat rectangle with rounded corners, black bezel, side ports and metallic rim in their electronic devices well over a year before the release of the iPod Touch or iPhone. Samsung's current devices share the look that those earlier devices of theirs had.

The JooJoo matches the Apple document precisely, yet was revealed and released before the iPad.

I agree with you that it will take the courts to unpick the technological patents, and that Apple may well have a good case there, but this injunction is about the look of the devices and the packaging.

Apart from the fact that it shows 'colourful icons' when you switch it on, it is to do with the look: basically a flat rectangle, with black bezel, rounded corners and a metallic trim, all of which were recognisable Samsung trade dress from before Apple used them.

As I said in the same post you quoted me from, functionally I think Apple may have a point.

I was looking for the specs of the ipad, and I found this article.

LG Display (LGD) reportedly has lost some 9.7-inch iPad 2 panel orders to Samsung Electronics and Chimei Innolux (CMI) after its recent shipments to Apple experienced quality issues, according to industry sources.

It's from the same day as the article from the OP. I wonder how they negotiated things:
Apple: we need 2 million screens
Samsung: we're busy making screens for the Galaxy tab, people seem to like it
Apple: we'll help with that

Was this supposed to be funny ? Because it certainly is not elegant nor nice to our german MR members. I know you and Rock will say it is not personal, nor that you think apple is behaving brillantly, but Schadensfreude (google it if you don't know what it means) is certainly not going to help keep this thread free of the agressivity you certainly do not want to provoke.

Well it was suppose to be a snark remark against the German legal system. Who either through incompetence or corruption has denied it's people and 13 other European countries access to a product solely based on a frivolous law suit.

No I don't think Apple is acting brilliantly. But this is not a dig on Apple. I didn't like it when MS pull this stunt, I didn't like it when SONY did either. I don't like it when Soccer players take a dive to get a penalty,etc...
Just because one can do it doesn't make it okay. People should complete in an ethical and moral manner.

You're asking the wrong person. I say you take this up with the German legal system.

But based on your quote you're using the wrong cliche. You imply the ends justify the means. And to that I disagree.
