Ahh I didn't realize we were only talking of DRM circumvention and not tools that allow piracy in general when legality of selling such software in certain countries was discussed.

So the laws do not apply to non DRMed goods in any way even if the distributer prohibits copying? Seems unjust.

Only if you send it to more than one person or your mom does. And of course why keep it on your hard drive as you have no further use for it your mom can send it back in case you do?

As a backup for when my computer-illiterate mom inevitably loses her copy.

Ahh my mom is too computer illiterate to even delete her copy. Oh well I can manage her kindle online at least. The big redeaming quality in having bought her a kindle.

Yep! I did do that, in fact.

'Course, right now the tip jar is Paypal. I need to get a few more options for people who can't use Paypal.

Absolutely -- Paypal takes a cut of every donation. But then, so does Amazon. *sigh*

Deleting a file is not the only way to lose it, sadly.

The next time I need to fix her computer I'm setting her up with a limited Guest account that limits everything. Less of a headache for me that way.

Well, the DRM circumvention laws obviously don't apply to things with no DRM.

There are other laws that prohibit devices intended solely to infringe copyright, but that's a much higher bar to meet. There was a famous case against the video cassette recorder in the US (which the media companies lost, much to their later profit) and I remember a case in the UK against a cassette tape recorder/player with two decks.

It would probably be tough to do if the author were dealing with a Big 6 publisher, but for someone doing self-publishing, it seems to me that it would just be a matter of putting a sentence on the last page of the book: "If you got a copy of this book for free, from a friend or off the internet, and liked it enough to read it all the way to here on the last page, you can tip the author at <insert web page>" where you will also find other books available for purchase."

Sorry for the mini-rant. This sort of false equivalency irritates me.
See VydorScope's post for an explanation of the delusion that it is not theft. I generally refer to your explanation, which I have seen before, as a "Robin Hood complex": claiming to be taking from the rich to give to the poor - always carrying the implication that the author is rich (don't I wish!) and that the perpetrator is poor. And the perpetrator gets that lovely fuzzy - self-delusional - feeling that they've not damaged anyone along the way, always careful not to think too hard about it all in case they realise their mistake.

If I write a bad review of your artwork, telling people how awful and useless it is, and then you can't sell copies of it--have I also "stolen" your ability to make profit?

There's a big difference between taking something *away* from you, and changing the marketplace so that your efforts are no longer suitable for sale. While changing the marketplace might be wrong, and might even be a crime, it's not "theft."

(US District) Judge: 17,000 illegal downloads don't equal 17,000 lost sales

"Those who download movies and music for free would not necessarily purchase those movies and music at the full purchase price," [Judge James P.] Jones wrote. "[A]lthough it is true that someone who copies a digital version of a sound recording has little incentive to purchase the recording through legitimate means, it does not necessarily follow that the downloader would have made a legitimate purchase if the recording had not been available for free."

Piracy in general is not theft. That's simply the language of lazy dinosaur media companies who refuse to change their business model.
