It's not his job to search for owner full time, so I think it's pretty reasonable to call service desk to locate the owner of the phone. How for god sake will police know better who the phone belongs to or the bar owner, then the customer support? Are you really saying that anybody who ever found anything in CA and didn't turn it to police is a criminal and can be prosecuted? Is CA police is Lost and Found department filled with beach balls, cell phones and lighters?

That is the law a lot of places. Say you find a wallet in target and take it (and the money in it) rather than taking it to Customer Service. You could be charged with a crime if you somehow got caught.

Now that doesn't mean how this case handled was right at all, with the kicking down of the door etc. It was a clear excessive use of force etc.

I don't know - did he take it apart and post pictures of it on the interwebz?

Again, under California law the phone was stolen property and gizmodo admitted to possession of it. Although Elfwreck's point a couple posts above is an excellent one - I too hope Gizmodo has documentation that Apple originally told them it was not their phone.

In the most recent articles, the college kid that found the phone may no attempt to find the owner. He did not call Apple or even let the bartender know. He just left the bar with the phone in hand.
