Apparently the kid should still have his notes, unless he intentionally wiped his Kindle. Notes for all of the e-books on a Kindle are saved in a text file called "My Clippings." It's easily accessible just by connecting the Kindle to a computer via USB. I didn't have any of my books wiped out, but kid's notes ought to remain in the file. If so, there go the damages claim.... |

it may be that everything associated with the book is wiped. After all, Amazon didnt foresee that any deletion would be due to illegal uploads, but only to 'not wanting the book', and if you dont want the book, any annotations on the book should be gone as well.

At least he is not asking for a stupid sum of money, blocking Amazon from ever deleting a book purchased is a good move.

Well, the kid found his notes, but claims they are "rendered useless" because he can't figure out what part of the books it references. He's definitely asking for monetary damages, though the amount is not specified as far as I can tell. |

Sucks for him but I definitely don't think it is worth suing over. I mean the guy is 17, I think it's pretty likely his analysis of 1984 wasn't groundbreaking, and his high school 'assignment' is probably 5000 words, so not a huge stretch.

I think his case will be as strong as his laywer is imaginative...or Amazon may go down the road of "He'll win if it ever gets to court in the first place" ala Wal-mart theory of law....
