So no one will hear of the law. Aside: I regret to say, I did not actually think the EU was that stupid. In fact, I thought it was not biologically possible for anyone to be that stupid. I should never have underestimated the power of stupidity. |

My initial reaction was "Haha, very funny. But that wouldn't even make a good Onion article. It's too unbelievable".
And then I looked around. And considering some of the things that recently came out of Europe, I had to re-evaluate. I really did seriously underestimate their sheer awesome stupidity. Which is hard! ![]() |

Fine. Implement such a law. Then remove all hyperlinks leading to European based online businesses. What fun. Their economy is doing so well they obviously do not need the money from online sales. You couldn't even look up their phone numbers and adresses for doing any business with them. Absolute idiots.

This IP thing has gotten absurd. Did Ernest Hemingways estate issue a letter of permission to use the text on that page you linked to? How does hyperlinking to a complete Page deprive the content owner? In the regular world, this is just called a 'referral': "Go see Mike at the corner garage". Is my mouth next to be under attack by lawyers? |

That's not entirely true. Remember, "fair use" is a defence against copyright infringement, so by claiming a defence of fair use you yourself are admitting that you've violated someone's copyright. It's then the job of the court to judge whether or not your use of the copyright holder's material falls within the usage limits granted under "fair use".

No if it's fair use you have NOT violated their rights. They are claimng rights that they never had and so violating YOUR rights. It is saying that what you are doing is not violating their rights in any way.

True, if the court rules that the usage is "fair use", you haven't violated their rights, but that judgement can only occur as the result of you making use of copyrighted material and then claiming "fair use" as a defence when legal action is taken against you as a result.
