I applaud what Google was trying to do, but unfortunately for them it violated current copyright laws. Judge Chin seems to be in favor of some type of "opt in" instead of an "opt out" provision. Of course, this completely guts the Google repository.

It should be opt in. The only problem with that would be orphaned works. The solution there would be appropriate legislation.
