Kindle piracy
There seems to be a flurry of copyright infringement at Amazon at the moment.
By the look of it most of the ebooks being put up for sale are being downloaded from [deleted - Moderator] - if you've posted anything there it might be worth having a trawl through Amazon's stock. If you've suffered, one of the victims is retaliating - see http://theystolemybook.com Last edited by Dr. Drib; 02-05-2011 at 01:44 PM. |

They got one of my free short stories called "Test Pilot" too. Mark Coker at Smashwords contacted them and a lot of the copies were corrected or frozen.

As bad is the habit on Amazon.co.uk of downloading then getting an immediate refund which is a result of distance selling laws in the UK.

I would imagine that anyone who made a habit of it would find their account closed. Amazon haven't been slow to do so in the past with people who buy and return items excessively.

They do it with people who pretend not to get posted items too often as well. I was quite surprised Amazon would let you return an ebook, I don't think anyone else would. I returned one a while ago because it was Topaz, and I didn't know how to spot them at the time.

I've actually been onto Amazon and bought one of the books listed by theystolemybook.com (£2.98 - don't worry, nobody's going to get rich). The Ice Cream Memories of Charlotte Rowe looks to me like a poorly converted PDF - apostrophes replaced by little squares, headers and footers in the middle of the text and some weird images scattered all over the place that look as if they might have been OK on a pdf viewed as a double page spread. All of which is odd, because the author has a perfectly good prc version on her website dead-medium.com. Why not steal that?
Anyway, I do think that Kindle owners and would-be publishers should take this seriously. Amazon are so desperate to establish a market that they seem to be applying no technical quality control at all. If they're not careful the Kindle Store will end up a shoddy bazaar like eBay. |

I am afraid "distance selling" regulations mean refund have to be offered on goods bought by mail or over Internet. the same applies to commercial sellers on ebay in the UK

Non-tangible items are exempt from the DSR though. This will be Amazon doing it voluntarily rather than being forced to do it. With the 1 click purchasing thing it would be easy for people to buy the wrong ebook, so they will be looking to avoid any bad publicity about people being forced to keep ebooks they didn't want. It's not as if it would cost Amazon anything to refund them.

If eBooks are " non-tangible" items would some one please tell HM Revenue and Customs because they have made eBooks VAT chargeable whereas paper books are tax free!

All non-tangible items are subject to VAT. Even American owned sites that sell them are supposed to add VAT for UK customers, though most of them don't.

Did you go in having a fit about it, or did you try to engage with the people who were considering reading it for free and ask if there was any compromise you could all reach? Did you thank the person who thought it was good enough to promote it on the site in question but question their actions/motivation?

Don't know if it was a good idea or not, but as one of the authors whose work was pirated I have just uploaded an "authorised" edition of the book to Amazon. This doesn't confer any particular copyright protection of course, but before they nick something the bad guys may check to see if it's already on sale. Possibly. Or not. Who knows how their minds work?
