Can you will your ebooks to someone?

I was talking to my husband about this the other night. I have left my physical library to him in my will, but what about the ebooks that I am acquiring. Can I legally will my ebooks to someone? What needs to happen to make this legal in the States?

I wondered if anyone has any input on this topic.

That's a good question. One thing I am pretty sure you can do is provide the login credentials for the digital store.

But, if you read the licenses with these stores they claim you are licensing the book and not buying it. There have been alot of questions about "digital" property that I think are going to have to be answered by the courts or legislation very soon. I am sure that many people have this question about there MP3 and digital movies too.

As far as I understand the DMCA, ebooks are transferable on the device they were purchased and licensed on. So one could 'pass along' their reader along with the books that are on it. As to the legality of the DMCA itself, that is another question entirely.

I have seen this issue addressed only to the extent of license transfer, that is, transfer of the DRM to another person. And I do believe this can be done. I have a significant amount tied up in WordSearch bible eBooks and they can be transferred via a will.
