So the BPHs rolled on Apple? Only thing of note is that it took this long. (shrug) It's been a slow (ebook) news week, so let's pop the corn and sit back... Apple fans vs BPH apologists. Wheee! |

Well at least we now have definitive information from the Huff with its "two people familiar with the matter" providing the data... |

I've come to distrust "two people familiar with the matter" lately. "An insider close to both parties" has a slightly better track record I think, but "underling who eavesdropped on boss's half of a phone conversation" is my personal favorite. That guy always knows what's up.

BBC News now has this as a "Breaking headline": US regulators file a suit against Apple and major publishers over the pricing of e-books. Edit: They now have a very brief article accompanying the headline. Only Hachette, HarperCollins, Macmillan and Penguin are mentioned. I guess the other two settled? Edit: I've converted the complaint to an ebook, for easy lunchtime reading! Download it from post 100 on this thread (here) Last edited by JonathanH; 04-11-2012 at 04:24 PM. |

Other news outlets are now updating their stories. There was obviously last-minute scrambling by some of the publishers to reach a deal. Bloomberg expands the list of "who's been sued" to five (adding Simon and Schuster), but then in the very next sentence says that Simon and Schuster, Hachette, and HarperCollins have all settled. So... just Penguin and Macmillan? If we trust "people familiar with the matter", that is The U.S. sued Apple Inc. (AAPL), Hachette SA, HarperCollins, Macmillan, Penguin and Simon & Schuster in New York district court, claiming the publishers colluded to fix eBook prices. CBS Corp. (CBS)’s Simon & Schuster, Lagardère SCA’s Hachette Book Group and News Corp. (NWSA)’s HarperCollins settled their suits today, two people familiar with the matter said. |

Apparently the suit was filed in New York. I have seen some reports that only Apple is listed as defendant, and the publishers as witnesses, but I need to see it. Very strange the Big 6 would act as one with Amazon at this time. And very stupid of Amazon to be taking a position that required such a collusive response. Amazon is going to be next in the DOJ spotlight. And they are already there vis-a-vis state taxing authorities. I would think lying low would be the better course.

Dollars to donuts, the real plaintiffs are Wal-Mart, B&N, and Target. They're the ones who lost when the agency model came out, because they could no longer discount products lower than an independent retailer. Either way, the consumer loses. |
