If the reason is that you already have an in-line TOC, you can extract/generate/provide an OPF file for your source and add a //guide/reference of @type="toc" pointing to your existing in-line TOC. That will prevent a new one from being generated.

I have my own Idex, yes. And I don't want to get a TOC, because I want my index to be like I made it. Also I want it in the specific place I put it. I didn't understand quite well the "@type=toc" thing. Can you explain it a little easier, please?
About DRMs... I'm not discussing about the goodness or evilness of it. I just need them on.
