The OS is the firmware.

The reason I'm asking is that someone at one of the local Apple Stores claims that all the issues with the iPad have been fixed. And since there hasn't been a firmware update, it has to be hardware and thus, it would seem that all those who rushed to get an iPad get (yet again) screwed by Apple for going for the first released version of a new product.
