I'm relatively sure ePub doesn't create a TOC on top or bottom. I may be mistaken but isn't the inline TOC that you see at the beginning of your file also in your original document? The auto generated TOC for ePub is not inline but is a menu item.

I've never created MOBI files so my guesses were limited to my initial thought. Hopefully someone with more knowledge with MOBI will step up.
