Hmmm ... everything available is inherently copyrighted by its creator, whether formally submitted to a country's copyright issuing agency or not.

It is nation-by-nation selling restrictions that I believe you are talking about, and not whether or not an author's copyright is valid.
Different countries have different copyright laws and different lengths of protection. A work might well be out of copyright in Canada, but still in copyright in the United States of America. And, oddly enough, vice-versa.
