TOC indenting behavior

When using h1, h2, h3, h4, h5 the TOC is successively indented, but ONLY if sequential. For example:
h1 part 1 of 2
h2 chapters
h3 subchapters
h4 subsubchapters
h5 captions of images
All is well if h5 follows h4, but if h3 has h5 after it the indentation of h5 is the same as h4:
h1
h2
h3
h5
h4
I would have thought it would look like:
h1
h2
h3
h5
h4
