Ebook piracy existed long before Amazon started selling ebooks, but Amazon still announces record ebook sales every year. Why aren't people just downloading the pirate ones for free instead? People are also paying money for public domain books like Sherlock Holmes (best selling ebook title on Amazon UK), so it can't just be because of legality.
