This sentence opens the second section of the Salon article linked earlier. For Amazon opponents, this is the smoking gun. Unfortunately, it is not and has never been true.
In their original Kindle
press release Amazon officially described the $9.99 price point this way:

More than 90,000 books are now available in the Kindle Store, including 101 of 112 current New York Times Best Sellers and New Releases, which are $9.99, unless marked otherwise.

The price only applied to certain books, most of which were on the NYT Best Seller list, and generally went up once the books left the list.
The overview in the Salon article may be clear, but it provides that clarity at the expense of accuracy, and a clear explanation on a false foundation does no one any good.
