Upgrading after a HD crash may not be necessary. Once you upgrade, you should receive a valid Windows 10 product key and will likely be able to install Windows 10 straight from that point on. We won't know for sure until MS addresses this directly, but I suspect this will be the case. Either way future reinstalls won't cost anything on that device.
