apple is pushing to make it illegal in the US, they are citing the DMCA which prevents things such as reverse engineering and decrypting the OS images.
i guess if your dock port was broken (easily done, shove something in it) you might have some difficulty wiping it clean, but i can think of a dozen ways to do it from the command line to wipe the OS and have a completely non-functional unit to take into apple. not exactly honest. but..
