Never used epub validator so I don't have an answer, but you might want to list which version you're using. Are you using CS5 or CS4 and if CS4 is it the 6.0.5 update?

Also IIRC epub validator uses ePub Check as it's engine. Not sure if it's still the case, but I remember ePub Check having a few bugs.
