CBS is testing H.264, which is NOT part of the HTML5 standard.

H.264 is a proprietary standard, from the MPEG-LA consortium, which as of 2014 will start imposing royalty and license requirements. Apple is a patent holder in the MPEG-LA consortium.

For what it's worth, the new Flash Player also supports H.264.
