It's not infringement, as the original was posted on imgur through Reddit, which has a policy that the image will be shared thereafter in their TOS. Besides all that, Harry would have to remove his avatar if what he said was true, as he does not own nor has he gained a licence to use the Dalek he shows so prominently, nor has he even attributed the image to anybody as he should really do under fair use. If what he'd said was true then the whole music section of this site would have to be shut down and most of the avatars on here removed.
