By Swedish (or Polish or French or Chilean or...) law it probably would be, since, as you say, it's a "local" sale. Since the actual seller is waaaay outside the reach of the Swedish (or etc.) authorities, though, they can expect to get away with routinely breaking the law without ever paying a penalty for doing so.
That said, a delightfully-appropriate way of drawing attention to the problem might be to organize an arrest for conspiracy to commit tax fraud next time John Sargent visits Europe...
