The short answer is "maybe".
The long answer is "Maybe. It depends on the exact provisions of the contract(s) involved, what your local lawmakers (and/or courts as appropriate) have to say about the legality of those provisions, whether or not anybody can be bothered to launch an investigation into whether or not laws are being broken, and whether or not a decision is made that allowing the situation to exist/continue is in the public interest. And all of these things will vary wildly according to your location, so something that is normal business practice in Sweden may be considered shady-but-legal in France and outright criminal in Australia."
