Amazon knows who bought the Kindle and to which account it's registered (that serial number leaves a trail), so I would say they have proof.
I think it's great that they're paying for the Kindle to be shipped back to Amazon. Even if the owner has to repay the shipping, it's good that Amazon is making the effort to help get the Kindle returned to its owner.
