Under English and Welsh law, unless you're selling a House, then your ability to enforce a valid contract is based on your ability to prove it was entered into, and that there was consideration on both sides*. It's entirely possible to conclude contracts by email, for instance.

(*consideration is not an issue in Scottish law, the rest applies...)
