I think lawsuit issues are more likely than this since the last correspondence between B&N and the FCC apears to have been B&N giving the FCC what they requested on 11/10/09. But it is the government, so maybe it is still being processed. If so, I am sure they will finish processing the request in the next 6 to 12 months or so
