I can see that this particular 'not caring' is not important to EBay repeat business and they certainly don't need "word of mouth" advertising, but can the same things be said of small-time Bookeen?

I said that in answer to his/her request that Bookeen should either remove the falsely described auction from EBay or put up the FW for download. Under the assumption that the auction is not really running the not-released-firmware, the request that Bookeen remove an auction from EBay is asking very much from Bookeen. They have no direct influence, all they can do is contact EBay and ask them to remove that auction. And from my experience EBay is very, very lazy in their actions to protect their customers, and I bet that a relatively small company like Bookeen has not much more weight when dealing with a giant like EBay than any one of us here.
So it's not about Bookeen's obligation to care more for their customers than EBay. It's asking something from Bookeen which they cannot fulfill.
