The U.S. Berne Convention Implementation Act of 1988 came into force on March 1, 1989 making the United States a party to the Berne Convention. The Copyright Act of 1976 while narrowing the differences between the U.S. law and the Berne Convention, did not make the U.S. a party to the Convention. But the US still doesn't follow the Berne convention, despite 1988 act. See teh granfathering in the 1976 act, the 1988, and the 1998 Sonny Bono Act (aka The Mickey Mouse Preservation Act)...
