Wells died in 1946. In the UK (& EU) his works are currently in copyright for 70 years after his death, and will come out of copyright on 1st January, 2017

In Canada, they came out of copyright on 1st January 1997.

There is only one special case in copyright law in the UK, and that's Peter Pan.
