Apparently the kid should still have his notes, unless he intentionally wiped his Kindle. Notes for all of the e-books on a Kindle are saved in a text file called "My Clippings." It's easily accessible just by connecting the Kindle to a computer via USB.

I didn't have any of my books wiped out, but kid's notes ought to remain in the file. If so, there go the damages claim....
