Well... As long as Scotty is making the binaries available he's "distributing", and that makes him in as much violation of the GPL as Irex ...

(Mrxvt, x48, gnuchess and Sylpheed-Claws are all under the GPL, distributing a modified copy with no src is a no-no)
There's also issues with transparancy... Personally I would be wary of installing these binaries as, while I'm pretty sure they won't brick an Iliad, it would nice to follow through the changes ourselves...
TBH, the main reason I'm asking for source code is educational... It would useful to others porting and writing apps for the iLiad, both at the moment, and when the SDK comes out. (Assuming nothing substantial changes in 2.8, and above)... It would also be useful to have another pair of eyes on the code... We've seen how much there is to be gained from Scotty looking at, who is to say what more benefits we could get...?
As I think some would agree here... There's never a good reason to hide source code...
