It is certainly still in copyright in Canada.

Having been reminded of the recent case in the 10th Circuit Court by Ralph Sir Edward, I agree that currently it may be in the public domain in parts of the United States.

I suppose the question is, which state contains the MobileRead US server?

I'd suggest that it would be best not to upload it until things are clearer - i.e. the US Supreme Court has ruled one way or another.
