I assume you really want a NCX or Nav TOC
Calibre has a TOC tool (page with hand icon) available from the Library (I usually use that to just remove odd entries, but it is the full deal) and the Editor. look at what that can do.
h# headers is a common auto detect trigger (remember you can style Headers if you do not want Bold or the size) I usually do this (your problem) task in the editor, because the chapters wer not coded for auto detect. The easy , simple ones are a S&R or use the editing toolbag (PI): Modify
