Mostly that Kobo applies DRM when requested by the publisher and does not apply DRM where no request has been made.

Looking at my last 60 purchases from Kobo, 19 of them were DRMmed and 41 weren't. If you use the download link on Kobo's website, a DRMmed ebook will download an .acsm file while DRM free ebooks will download the ebook file.
