While the percentage is probably indeed very low, there is enough large scale operations to ruin it for the more honest law-breakers that are circumventing DRM under the fair use excuse. Fair use exists in the USA, but it has never been tested in court if it also applies to ebooks. Other jurisdictions specifically prohibit removal of DRM from ebooks for any reason. As far as I am aware, there is no part of the world where fair use is legal for ebooks.
