Yes, they are proven to be pirates and ignoring court judgements.

A Manhattan judge ruled for publisher Elsevier in another case against LibGen in 2017, but the new lawsuit said it ignored court orders and continued its alleged piracy using different web domains.
Using them deprives authors of income, not just big greedy publishers.
