Almost all sales are civil contracts and the company suing has to prove loss.
You can't add copyright newer covers to a PD ebook you re-share (unless you own copyright or pay royalty etc), but you can add them for personal use. The copyright covers are essentially adverts, so can't be used to "repackage" a product (even if same text) for any 3rd party, only for your own use.
