I think it depends on what mechanism kobo is using to update the recovery partition. It's entirely possibe this is being done without changing the running firmware at all.

I'm not sure there is any way to verify that the recovery partition has been updated without either examining the storage media outside the kobo, or some form of root shell access of the kobo.

But keep mind, this 'deadline' only affects your ability to do factory reset without the help of an attached computer. Of course, Kobo doesn't want their support center flooded with this problem, and there are a certain number of Kobo devices owned by people without access to a PC, but it's not what I would call *critical*,, just convenient.

Edit: It is far more important to ensure that the upgrade process is as flawless as humanly possible.
