Doesn't matter. It's so easy to make these eBooks backwards compatible. ADE 2.0.1 is there to make sure that eBooks work well enough. If they work with ADE 2.0.1, they'll work pretty much anywhere.

Plus, ADE 2.0.1 is there because DeDRM did not have support for the newer DRM. The current DeDRM code does have support.

But why make these eBooks with such code when they don't need it? Sure, they can be ePub 3 with accessibility. But they can also be made with simple CSS.
