The battery cell would not charge at all if it was completely discharged. There is a margin and then it disconnects. Usually stuff is shipped at 20% to 70% charged. If the ereader charged to 100% and then linearly drops slowly rather than a big initial drop, then it's probably OK.
The firmware date isn't important, only the manufacture date of the cell and when it was last charged.

You don't say where you are, but if there is a problem you can ring Kobo in many countries.
