Yeah, the difference of course is that people know how books are licensed and are unlikely to let them get away with that if they try to claim that that actually *is* how it works, and not only ebooks. Courts have already thrown such claims out in some jurisdictions -- like the EU as a whole because one of these courts was the CJEU -- saying that the (various EU names of) right of first sale applies to ebooks and software in general just as much as it does to books.
